    Bradley Cosgrove Obtains Near Record Medical Malpractice Settlement in DeKalb County

    Bradley Cosgrove, partner at Clifford Law Offices, obtained a $2.75 million near record settlement in a medical malpractice case in DeKalb County on behalf of a widow and two surviving minor children.

    The case involved the alleged negligent failure of an Advocate hospital to appropriately assess, diagnose and treat Daniel Koch’s deep vein thrombosis during a three-day admission following a serious automobile accident. The 45-year-old husband and father from Sycamore, Illinois, died seven days after being discharged without any pharmacological treatment for deep vein thrombosis despite having a known past medical history of blood clots and pulmonary embolus.

    “The hospital had policies and procedures in place to accurately assess Daniel’s condition,” Cosgrove said. “If these policies and procedures were followed, Daniel’s death would have been prevented.” Marta Kowalczyk Davidson, associate at Clifford Law Offices, assisted in the preparation and settlement of this case.

    Judge William Brady approved an order Tuesday (Feb. 25, 2014) in the case approving a partial settlement of $2.75 million to be paid by Advocate. The case continues against three individual physicians and their respective corporations.

    The existing record settlement for a death in DeKalb County was $2.65 million.
