Unhappy Condominium Owner - Advisory from ISBA

Question: If a condominium owner is unhappy with the way that the property is being cared for, can he or she stop paying assessments? Answer: Not according to Illinois law. Condominium board members have a duty to maintain the common elements, and the owners are bound by statute to pay their portion of the expenses. Owners have several options for disputing assessment charges and board performance, such as challenging the association's record-keeping, taking steps to remove an offending board member, seeking election to the board themselves, and filing a lawsuit.
