Colin Dunn, partner at Clifford Law Offices, authored an article for the Illinois Trial Lawyers Association (ITLA) on "Rule 191(b) Affidavits: Should Lawyers be Able to Sign Them?"
The article appeared in the Winter 2016 issue of the ITLA Trial Journal that is disseminated across the state to all of its members.
Dunn, a frequent speaker at ITLA seminars, wrote an interesting article based upon his experience involving one of his recent cases involving a woman who was attacked in a grocery store parking lot. He goes on to explain how it would be better for a lawyer, rather than a non-lawyer client, to sign an affidavit regarding facts that are not attainable or unavailable.
