The Illinois legislature voted to cap damages on medical malpractice
cases in this state in 2005. This now means that for non-economic
damages, a patient's recovery is limited to $500,000 from a doctor and
$1 million from a hospital. Robert Clifford wrote an article in the

Plea to Stop Caps Legislation Fell on Deaf Ear, which explains how
this legislation impacts every patient victimized by malpractice. In
passing this law, legislators lost sight of the victims of malpractice
such as Molly Akers, a vibrant, young mother whose breast was
unnecessarily removed when a pathologist negligently mixed up her slide
with another patient who did have breast cancer. Molly bravely spoke
before Illinois legislators, urging them to vote against the pending
legislation. With Robert Clifford and Keith Hebeisen at her side, she
told them her story, and of how it could happen to anyone, how given
her situation of being a stay-at-home mom, she would be discriminated
against by the law. But a majority of lawmakers ignored her plea and
the bill became law until it is tested once again by the courts. The
Illinois Supreme Court twice has found such legislation
unconstitutional.
