Clifford Law Offices Obtains $975,000 Verdict in Med Mal Case
Press Release, 07/26/2005Clifford Law Offices obtained a $975,000 verdict late Tuesday, July 26 in Cook County Circuit Court following a six-day trial on behalf of a 40-year-old woman from Fox River Grove who suffered a debilitating leg injury following routine surgery by her gynecologist.
Jeffrey J. Kroll and Sheri L. Tarr, attorneys at Clifford Law Offices of Chicago obtained the verdict before an eight-man-three-woman jury that had deliberated for just three hours. The verdict was solely in the form of non-economic damages for pain and suffering, disability and disfigurement. There was no offer prior to trial to settle the matter.
Lisa Rseszutek was injured when Dr. David C. Schewitz of Lake Forest compressed her femoral nerve with a retractor during routine surgery to remove fibroids. The verdict was reached against Dr. Schewitz and his professional corporation, Lake Forest Obstetrics. The incident occurred Jan. 21, 1999.
"This verdict is very gratifying for Lisa because for six years her doctor has refused to accept responsibility for his wrongful conduct that clearly will impact her for the rest of her life," Tarr said following the verdict. "She will be in pain for the rest of her life despite intensive rehabilitation, and she will no longer be able to enjoy competitive physical activities like karate and distance biking that defined her as a person."
The trial was held before Judge James P. McCarthy at the Daley Center.
