Clifford Law Offices Settles $3.25 Million Wrongful Death Case
Press Release, 04/26/2001Judge Donald P. O’Connell approved the settlement late yesterday of a medical malpractice case involving the death of a 55-year-old man caused by the doctors’ failure to diagnose his pulmonary embolism.
Keith Hebeisen, partner of Clifford Law Offices, reached the settlement on behalf of a west suburban Hoffman Estates man. The settlement was reached against a west suburban medical center and a group of cardiologists.
The man went to the medical center’s emergency room in 1995 complaining of dizziness, sweating and a constricted feeling in his chest. He was admitted to the hospital and when his right leg and ankle began to swell. Despite testing, the defendant doctors failed to perform the appropriate test to determine that Prather was suffering from a pulmonary embolism.
"This tragic event could have been avoided had the physicians taken reasonable precautions and conducted the test and provided treatment that clearly was indicated as a necessity here," Hebeisen said after the settlement was reached. "Mr. Prather was a healthy man whose life was cut short by the negligence of these defendants."
Hebeisen’s settlement comes on the heels of yet another settlement he reached in a medical malpractice case earlier this month for $1.375 million. That case, settled April 11, involved Rush North Shore Medical Center where doctors negligently performed a laminectomy on the lower back of a 59-year-old man from Skokie. Schwartz v. Luke, M.D., and Rush North Shore Medical Center (Case No. 98 L 62034).
