Rachel Barton Verdict Upheld
Press Release, 06/14/1999Cook County Circuit Court Judge Allen Freedman today (June 14) upheld the $30 million verdict in the case of violinist Rachel Barton against Metra and the Chicago and Northwestern Railroad.
Clifford Law Offices was successful in defeating the railroads' post trial motion.
The Defendants had filed a post trial motion asking the verdict be reversed and for a new trial. Judge Freeman denied the motion after a three-hour hearing that was held in his chambers at the Daley Center.
"The court carefully reviewed the issues in this case and determined there was no error that required reversal for a new trial," said Robert Clifford, principal partner of Clifford Law Offices .
Barton lost her left leg and part of her right foot and her right leg was severely degloved after she was pinned to the doors of a Metra train and was dragged 366 feet along the railroad's right-of-way. A jury awarded her $30 million March 1st after a month long trial.
