Clifford Law Offices Receives $3.6 Million Verdict on Behalf of Mother Who Died From Failure to Diagnose Cancer

Clifford Law Offices obtained a $3.6 million verdict on behalf of a 55-year-old woman from the western suburbs who died after her doctor failed to properly and timely diagnose her breast cancer.

Keith A. Hebeisen and Robert A. Strelecky, partners at Clifford Law Offices, obtained the verdict this afternoon on behalf of the estate of Linda Stenberg, formerly of Schaumburg, following a one-week trial.

The jury deliberated about seven hours before reaching the verdict against Dr. Kathleen E. Pearson, a family practitioner and osteopath, who was part of a medical practice group in Elk Grove Village and now practices in New Hampshire.

“This never should have happened,” said Strelecky.  “This now will help her mentally disabled daughter who lives in a group home.  The daughter’s disability was tragedy enough, and now she suffered the horrendous loss of her mom who was her sole support.  This verdict will help her now so that she can be taken care of properly, as her mother would have wanted.”  The daughter, now 23, is the sole beneficiary of the estate.

“It was gratifying that the jury understood the complicated medical issues and the clear negligence that resulted in the death of a woman who should be alive today,” Hebeisen said.  “Doctors have to be careful regarding the diagnosis and treatment of cancer because, as in this case, the mistake led to Linda’s life being cut short and her daughter losing her mother at so young an age.”

The case was heard before Cook County Circuit Court Judge Clare E. McWilliams.
