Answer: In addition to numerous Federal laws, the safety and rights of nursing home residents in Illinois are protected under the Illinois Nursing Home Care Act.  The Illinois Department of Public Health is in charge of enforcing the Nursing Home Care Act throughout the state.  The right to be free from abuse and neglect; restraints, unless ordered by a physician to protect a resident; and the ability to refuse medical treatment are among some of the resident’s rights. Alleged violations can be reported through the Nursing Home Ombudsman Program administered by the Illinois Department on Aging.
