Clifford Law Offices partner Jack Casciato, who focuses his practice on major truck accidents, premises liability and complex personal injury and wrongful death litigation, authored an article for the Chicago Daily Law Bulletin titled, “Case can be made for punitive damages against texting motorists”.
In the article, he discusses the statistics on car accidents as a result of texting and driving, how the law in Illinois prohibits texting while driving, and how states have spent millions of dollars on campaigns to make the public aware that texting and driving is unsafe. With these facts known to the general public, he goes on to say that when a motorist chooses to answer a text or email while driving it is a failure to exercise reasonable care and that “seeking the admission that (the defendant) made the ‘conscious choice to text knowing it places others in danger’ could be a sound basis to seek punitive damages.”
