UPS Flight 2976 departed Louisville Muhammad Ali International Airport on November 4, 2025, bound for Honolulu, Hawaii. Shortly after takeoff, the Boeing MD-11 suffered a catastrophic separation of its left engine and pylon assembly, causing the aircraft, which was carrying approximately 38,000 gallons of jet fuel, to crash into an industrial area near the airport. The impact and resulting explosion killed 15 people aboard and on the ground, injured at least 23 others, and destroyed multiple businesses, including Grade A Auto Parts.

In December 2025, Clifford Law Offices and Sam Aguiar Injury Lawyers filed the first wrongful death lawsuits arising from the crash on behalf of victims’ families, alleging negligence against UPS and UPS AIR, as well as GE, which manufactured the engine, and Boeing, maker of the MD-11 plane that crashed. Also named was VT San Antonio Aerospace, Inc., an engineering company responsible for aircraft maintenance. The 26-page complaint alleges failures involving aircraft maintenance, inspection procedures, crew training, engineering, and continuing airworthiness that contributed to the disaster.

The National Transportation Safety Board immediately launched an extensive investigation into the crash. The aircraft’s cockpit voice recorder and flight data recorder were recovered, and investigators focused on the failure of the left engine pylon assembly. The crash prompted the grounding of UPS’s MD-11 fleet while inspections identified fatigue cracking in a critical structural component. Industry attention quickly expanded to broader questions involving aging aircraft, maintenance practices, inspection intervals, and the continued operation of the MD-11 fleet.

During two days of NTSB investigative hearings in March 2026, testimony revealed significant concerns regarding Boeing’s certification and ongoing operational safety programs. Boeing acknowledged that the failed aft pylon spherical bearing should have been classified as a Principal Structural Element during the aircraft’s original FAA certification. Company representatives also admitted that Boeing’s ongoing safety review process failed to identify the catastrophic consequences of bearing failure, despite multiple prior incidents over two decades. Evidence presented during the hearings further showed that Boeing’s own Safety Review Board had identified the potential for aft pylon damage as early as 2007, yet no corrective action was taken.

Robert A. Clifford, who has represented victims and families in major aviation disasters for over four decades, noted striking similarities between this tragedy and the 1979 crash of American Airlines Flight 191 in Chicago, where an engine also separated shortly after takeoff. He emphasized that the aviation industry has long understood the catastrophic risks associated with engine-pylon failures and questioned whether aging aircraft, maintenance practices, and economic considerations were allowed to outweigh safety. “The aviation industry needs to learn not to repeat its mistakes. What is new about this case is that the age of the aircraft suggests that this plane was old, tired, and well beyond its useful life, certainly triggering questions about profit over safety.”

Following the hearings, Bradley M. Cosgrove, who leads the firm’s litigation team in the case, said the evidence pointed to failures extending well beyond a single component. According to Cosgrove, testimony revealed breakdowns in Boeing’s aircraft design and certification process, continuing airworthiness oversight, maintenance procedures, and communication among manufacturers, operators, maintenance providers, and regulators.
