Clifford Law Offices is sponsoring a free two-hour continuing legal education program on the ethics of settlement, negotiation and mediation in the fifth annual Clifford Law Offices Continuing Legal Education Series. The two-hour program will include an examination of various hypotheticals involving negotiation, settlement and mediation. These can be effective ways to advocate for your client, but when an outside person comes on the scene to help the parties come to a resolution, various ethical issues can arise. What are some of the questions that lawyers need to look for when trying to resolve their cases out of court? Inadvertent disclosure of confidential information, possible coercion of parties to an agreement,  unrepresented third parties and selection of an impartial mediator and the necessary disclosures before choosing one are some of the issues that will be discussed in an interactive program with people in the audience as well as those attending via the Internet.  Various Illinois Rules of Professional Conduct, Illinois State Bar Association advisory opinions and Model Standards of Conduct for Mediators adopted by the American Arbitration Association, the American Bar Association and the Association for Conflict Resolution will be discussed as the panelists explore this area that is becoming more and more common to resolve conflicts, simple and complex.
